{"id":18642,"date":"2019-05-20T15:35:47","date_gmt":"2019-05-20T19:35:47","guid":{"rendered":"https:\/\/cjs.tqa.temporary.site\/website_34d9c6f0\/?p=18642"},"modified":"2020-11-11T17:26:37","modified_gmt":"2020-11-11T22:26:37","slug":"new-law-for-nyc-residential-rental-properties","status":"publish","type":"post","link":"https:\/\/askesa.com\/website_34d9c6f0\/2019\/05\/new-law-for-nyc-residential-rental-properties\/","title":{"rendered":"New Law for NYC Residential Rental Properties"},"content":{"rendered":"<span class=\"span-reading-time rt-reading-time\" style=\"display: block;\"><span class=\"rt-label rt-prefix\">Reading Time: <\/span> <span class=\"rt-time\"> 3<\/span> <span class=\"rt-label rt-postfix\">minutes<\/span><\/span>\n<p>If you own, manage, or\nmaintain a residential rental property in New York City, an important new law\nwas passed recently that you need to know about. <em>Local Law #55<\/em>, effective as of January 2019, is NYC\u2019s Indoor\nAllergen Law that covers various pests and allergens. This article focuses on the\nnuanced regulations found in <em>Local Law #55<\/em> that govern mold issues.<\/p>\n\n\n\n<p>The new law states\nthat landlords must take reasonable measures to keep dwellings free from pests\nand other indoor allergen hazards \u2013 including visible mold \u2013 and to prevent and\nremediate such conditions if present. Owners must also repair underlying\ndefects such as pipe leaks or causes of pest infestations if they exist. These regulations\napply to all dwelling units, hallways, and commonly used areas such as laundry\nrooms.<\/p>\n\n\n\n<p>The law obligates\nresidential rental property owners to meet the following requirements:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Annual inspections of each unit and all common areas;<\/li><li>Distribution of annual notice and copy of New York City Department of Health and Mental Hygiene (DOHMH) pamphlet to current and prospective tenants;<\/li><li>Integrated pest management to address pest infestations;<\/li><li>Visual inspection and remediation of mold, pest, and underlying defects and thorough cleaning of carpeting or furniture before occupancy by a&nbsp;new tenant.<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p>There are three types of violations for visible mold in <em>Local Law #55<\/em>, and each has its own timeframe for corrective action:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Non-Hazardous Violations<\/strong>: When the amount of visible mold is less than ten\nsquare feet in a room within a dwelling unit or less than thirty square feet in\nany common area.&nbsp; Typically, these\nviolations can be addressed by properly trained maintenance workers or property\nowners. These violations will specify a timeframe to implement the corrective\nmeasures;<\/li><li><strong>Hazardous Violations<\/strong>: When the amount of visible mold measures (in total) between ten\nsquare feet and thirty square feet in a dwelling unit, or greater than thirty\nsquare feet in common areas. Hazardous Violations must be addressed by a New\nYork State Licensed Mold Assessor (such as ESA) and remediated by a separate\nNYS Licensed Mold Remediator. These violations also specify a timeframe to\nimplement corrective measures;<\/li><li><strong>Immediate Hazardous Violations<\/strong>: When the amount of visible mold measures greater\nthan thirty square feet in a room within a dwelling unit. Immediate Hazardous Violations\nmust also be addressed by NYS Licensed professionals, and must be addressed\nwithin 21 days.&nbsp; <\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p>Obviously, it is important to identify mold issues early so the area impacted remains below 10 square feet. Doing so will save building owners a substantial amount of money. Moreover, because mold grows as a result of water intrusion, all leaks must be fixed or the mold issue will persist and spread. <\/p>\n\n\n\n<p>Failure to comply\nwith the new law\u2019s requirements may leave owners subject to violations and\nfines from the NYC Department of Health (DOH) or the Department of Housing\nPreservation and Development (HPD). Compounding this, complaints must be\naddressed immediately to avoid potential lawsuits.<\/p>\n\n\n\n<p>As part of ESA\u2019s standard mold assessment protocol, our NYS licensed mold assessors utilize infra-red thermal imagery, moisture meters, and humidity\/temperature meters to collect diagnostic measurements. These data estimate the moisture content in both building materials and in the ambient air in the interior and exterior of the dwelling. ESA also utilizes a borescope to inspect for the presence of visible mold within accessible wall and\/or ceiling cavities and duct work. In addition, ESA inspects the interior and exterior portions of the dwelling to attempt to determine the source of water intrusion and the extent of suspected mold growth, and we also perform a visual examination of the HVAC system. Based upon our findings, ESA then prepares a detailed mold remediation plan to guide the mold remediation contractor.
