ISRA Compliance

The New Jersey Department of Environmental Protection (NJDEP) Industrial Site Recovery Act (ISRA) requires that the operator/tenant, and in some instances the property owner, of businesses with specific NAICS codes to verify that ‘ISRA-subject’ operations have not negatively impacted the subject property. Therefore, prior to selling or buying a property in which an ISRA-subject business is located, the responsible party may be required to complete a Preliminary Assessment (PA) under the supervision of a NJDEP Licensed Site Remediation Professional (LSRP). ESA’s team of LSRPs and environmental professionals will provide ISRA Compliance services to review the type of operation(s) and determine whether the property owner/operator is ISRA-subject. If an operator is subject to ISRA rules, then ESA will determine if the operator can satisfy ISRA with a Deminis Quantity Exemption (DQE) application or if the operation is subject to filing a General Information Notice (GIN) and enter into the Site Remediation Program (SRP), in which an LSRP must be retained. Actions which may trigger ISRA include cessation of operations, stock transfers, and sale/transfer of business ownership, to name a few.
